NO. <br />�Y3a.�.►,.Y4>: J Y <br />A RESOLUTION GRANTING <br />VARIANCES TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.23, SUBDIVISION 6 (B), <br />SECTION 10.22, SUBDIVISION 1 (A), <br />SECTION 10.03, SUBDIVISION 9 (A) <br />AND CONDITIONAL USE PERMIT PER <br />MUNICIPAL ZONING CODE <br />SECTION 10.03, SUBDIVISION 10 <br />FILE #1110 <br />WHEREAS, Robert Martinson (hereinafter "the applicant") has an <br />interest in the property located at 1840 Shoreline Drive within the City of <br />Orono (hereinafter "City") and legally described as Lot 2, Auditor's <br />Subdivision No. 356; Hennepin County, Minnesota (hereinafter "property"); <br />and <br />WHEREAS, the applicant has made application to the City of Orono <br />to permit the construction of a new residence on a lot that does not meet <br />the lot area and lot width standards per Section 10.22, Subdivision 6 (B) <br />requiring an area variance of .2 acres or 10% and a width variance of 72.5' <br />or 36.5%, per Section 10.22, Subdivision 1 (A) the ground floor deck of <br />s d principal structure extends 30 feet beyond the average lakeshore <br />s4 ack line and a lakeyard pool extends 60 feet beyond the average <br />l&-,ashore setback line, per Section 10 03, Subdivision 9 (A) a dock to be <br />constructed on the lakeside portion of the property, divided from the <br />homestead portion of the property by the County road, requires a variance <br />because a dock is classified as an accessory structure requiring a <br />principal residence on the same lot and per Section 10.03, bdivision 10 <br />grants a conditional use permit for the pool and rear yar_atieck tennis <br />court, accessory structures on a through lot. <br />Minnesota: <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />1. This application was reviewed as Zoning File 01110. <br />2. The property is located in the I.R-lA Single Family Lakeshore <br />Residential Zoning District. <br />3. The property is approximately 1.80 acres in area. <br />4. The Orono Planning Commission reviewed this application on March <br />16, 1987, and recommended approval of the proposed variances, and <br />recommended approval of a conditional use permit 'or proposed <br />accessory structures on the through lot located at 1940 Shoreline <br />Drive based on the following findings: <br />
