City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 2236 <br />A RESOLUTION APPROVING <br />A BUILDING PERMIT APPLICATION FOR <br />MIRE & MARY MCELLIGOTT <br />TO CONSTRUCT A DOCK ON <br />LOT 2, BLOCK 2 FOREST ARMS <br />WHEREAS, the Orono Council has reviewed a request by Mike & Mary <br />McElligott (hereinafter "the applicants") to construct a dock on that <br />portion of their property abutting Forest Arms Channel; and <br />WHEREAS, the applicants must obtain a building permit from the <br />City of Orono to construct said dock; and <br />WHEREAS, the Council has considered the application, the <br />application information submitted by the applicant and report of the staff <br />and hereby makes the following findings: <br />1. That on April 26, 1966 the DNR issued a permit for the purpose of <br />excavating a channel referenced to as the Forest Arms Channel to <br />"excavate and remove silt and earthen material from the bed of Forest <br />Lake . . . for the purpose of improving navigational facilities". <br />2. Lot 2, Block 2, Forest Arms has approximately 210 feet of <br />storeline abutting the Forest Ar.as Channel. The Forest Arms Channel <br />is navigable and riparian to Lake Minnetonka. <br />3. The issuance of a permit for this plan for limited dock <br />construction will create no hazards to navigation nor impair the <br />public safety or general welfare. <br />4. On June 23, 1987, the LMCD approved the plans for the construction <br />of a dock on the subject property finding the dock meets all required <br />standards of the district for docks constructed within channel areas. <br />NOW, THEREFORE, BE IT RESOLVED that based upon one or more of the <br />above findings, the City Council of Orono hereby approves the issuance of a <br />building permit application to construct a dock on Lot 2, Block 2, Forest <br />Arms, subject to the following conditions: <br />1. Prior to the City issuing a permit for the construction of a <br />residential dock, considered an accessory structure, the applicants <br />must have obtained a Certificate of Occupancy for the newly <br />constructed residence. <br />2. The applicants shall construct a dock in accordance with the <br />permitting conditions of both the City of Orono and the LMCD. Once <br />erected, additional permits for annual dock removal and replacement <br />will not be required provided the dock is always replaced in the same <br />location and configuration as approved in the original permit. <br />Page 1 of 2 <br />
