ORONO CITY COUNCIL MEETING <br />MINUTES FOR SEPTEMBER 28, 1998 <br />(#2419 Robert Lund on behalf of William and Anastasia Hoeft, continued) <br />setting the house on top of a hill which would put the house above the other homes in the area. <br />Mayor Jabbour stated he is in favor of the variance. <br />Kelley moved, Goetten seconded, to approve Application #2419, adopting <br />RESOLUTION NO. 4169, A Resolution Granting Variances to Allow for the Construction of <br />a Residence at 1655 Bohn's Point Road. VOTE: Ayes 5, Nays 0. <br />(#12) #2420 ROBERT RYAN, JR., 3535 CHRISTINE DRIVE -VARIANCE <br />The Applicants were not present. <br />Jabbour moved, Flint seconded, to deny Application #2420, 3535 Christine Drive. <br />VOTE: Ayes 5, Nays 0. <br />Van Zomeren stated the Applicants were notified of tonight's hearing. <br />(#13) ZONING CODE AMENDMENT -PLUMBING IN ACCESSORY STRUCTURES <br />Kelley inquired why the City Council was wishing to change the zoning code. <br />McMillan, Planning Commission Representative, stated the Planning Commission has been working <br />on this issue in an attempt to give City Staff some direction on how to deal with these applications. <br />Moorse commented City Staff had requested some guidelines on how to regulate plumbing fixtures <br />in accessory structures. <br />Gaffron stated City Staff wanted direction on how to deal with applications requesting the <br />installation of plumbing fixtures in accessory buildings. Gaffron stated this amendment allows City <br />Staff to issue permits without restrictions for certain items, issue permits subject to specific restrictions <br />or covenants for others, and to seek City Council approval whenever a conditional use permit is <br />required. <br />Mayor Jabbour inquired whether it is the City Council's intent to allow accessory structures with <br />plumbing. <br />Daniel Kluth, 2801 Fox Street, commented he understands the City Council's desire to regulate <br />these type of structures. <br />Mayor Jabbour stated this amendment would allow those non-conforming legal accessory structures <br />that have had the plumbing removed previously to re-install the plumbing. <br />McMillan stated overall accessory structures pose a problem to the Planning Commission and City <br />Staff and guidelines need to be established for the City to follow. <br />Page 10
