CITY of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 4 l 6 ~1 <br />A RESOLUTION GRANTING <br />VARIANCES TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.56, SUBDIVISION 16 (C) (6) <br />FILE #2419 <br />WHEREAS, William Hoeft and Anastasia Hoeft (hereinafter "the applicants") <br />are owners of the property located at 1725 Bohns Point Road within the City of Orono <br />(hereinafter "City") and legally described as follows: <br />Lots 4 and 5, Auditor's Subdivision No. 349, Hennepin County, Minnesota <br />(hereinafter "the property"); and <br />WHEREAS, after due published notice and mailed notice in accordance with <br />Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning <br />Commission held a public hearing on September 28, 1998, at which times all persons desiring <br />to be heard concerning this application were given the opportunity to speak thereon; and <br />WHEREAS, the applicants have applied to the City for variances to Municipal <br />Zoning Code Section 10.56, Subdivision 16 (C) (6) to permit the construction of a residence <br />encroaching 3 5' into the average lakeshore setback and a pool terrace encroaching 40' into the <br />average lakeshore setback where no encroachment is normally allowed. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />Minnesota: <br />FINDINGS <br />1. This application was reviewed as Zoning File #2419. <br />2. The property is located in the LR-lB, One Family Lakeshore Residential Zoning <br />District, where 1 acre or 43,560 sq.ft. is the minimum lot area. The property <br />consists of 2.92 acres or 127,382 sq.ft. <br />Page 1 of 4
