(hereinafter the "Developer") has an <br /> znterest in the properties at 190 Willow Drive North a.nd 177 Glendale Drive legally described in <br /> Exhfbit A attached hereto (hereinafter the"Property"); and <br /> WHEREAS, the City Council has considered the application by the Developer <br /> for rezonu�zg of portions of the Froperty to RPUD - Residential Plaraned Unit Developrnent as <br /> well as subdivision and development of the Property by the Planned Unit Developm�ent (PUD) <br /> process; and <br /> 'WHEREAS, on February 13, 2006 the Ci�ty Counci� adopted Resolutioa No. <br /> 5420 granting Gen�ral Concept Plan Approval for the proposed development, which approval <br /> ineludes the following elements: <br /> 1. Subdivision platting of the Property to create eight devalopable single family residential <br /> bui�ding lots to be served by a new public road, as well as two additional lots <br /> encompassing tlze existing residence at 190 Willow Drive North and the existing church <br /> at 177 Crlend.ale Drive, to be designated as I,ots 1 through 10; <br /> �. Rezoiung of Lot 1 and Lots 3 through 10 from RR-1B Sin;le Family Rural Residential <br /> District to RPUD Residential Planned Unit Development Distri.ct; <br /> 3.
