The <br />applicant seeks to install a four inch solid pipe from t!,c unit to <br />Lake Minnetonka. This pipe will be buried underground; and it will <br />not involve the addition of any surface hard cover. <br />The pipe itself will have no adverse impact on the City. The <br />excavation which is required is minimal. <br />The pipe to be installed is similar to one which the City has already <br />approved for this site for a foundation drain. <br />The only sensible alternative fc candling the groundwater discharge <br />for the geo-thermal unit which i; being installed is to divert the <br />water through a pipe from the uni, itself to Lake Minnetonka. Lake <br />Minnetonka serves as part of the aquafir from which the groundwater is <br />originally drawn. By discharging in this manner, the water will <br />simply be returned to its original source. The DNR has approved the <br />discharge in Lake Minnetonka. <br />d. Granting of a variance for the installation of the pipe shall not <br />violate any of the criteria set forth in Subdivision 25 of the City <br />Code <br />There is no evidence to indicate that granting the variance requested <br />for the pipe will: <br />1. Increase the height or duration of flnod water in or along <br />Minnehaha Creek. <br />2. Result in the placement of an artificial obstruction which will <br />restrict the passage of flood water. <br />3. Result in an incapatible land use. <br />4. Be detrimental to the protection of surface and ground water <br />supplies. <br />5. Increase the financial burdens imposed on the community. <br />6. Be contrary t land use plans and planning objectives of the City. <br />7. Increase or cause danger to life or property. <br />8. Be inconsistent with the objectives of encouraging land uses <br />compatible with the preservation of natural land forms, vegetation in <br />the marshes and wetlands. <br />
