The City Council approved after-the-fact variances to allow an accessory <br /> structure on the lot, with the condition that future proposals for additional <br /> accessory structures on the property may result in the requirement to <br /> remove the existing shed. <br /> B. The outlot was created for the purposes of holding a gray water septic <br /> system to serve the three adjacent properties, although sanitary sewer has <br /> been provided and the septic system is no longer necessary. <br /> C. The outlot is jointly owned by the adjacent property owners located at <br /> 3424, 3444 and 3464 Eastlake Street. <br /> D. All property owners support the applicant's proposal. <br /> E. The size of the accessory structure shall not exceed 140 s.f. <br /> F. The proposed location of the accessory structure has sufficient screening <br /> to reduce the visual impact from Bayside Road. <br /> 5. The City Council finds that the conditions existing on this property are peculiar <br /> to it and do not apply generally to other property in this zoning district; that <br /> granting the variance would not adversely affect traffic conditions, light, air nor <br /> pose a fire hazard or other danger to neighboring property; would not merely <br /> serve as a convenience to the applicants, but is necessary to alleviate a <br /> demonstrable hardship or difficulty; is necessary to preserve a substantial <br /> property right of the applicants; and would be in keeping with the spirit and <br /> intent of the Zoning Code and Comprehensive Plan of the City. <br /> 6. The City Council has considered this application including the findings and <br /> recommendations of the Planning Commission, reports by City staff, comments <br /> by the applicants and the effect of the proposed variance on the health, safety <br /> and welfare of the community. <br /> Page 2 of 6 <br />
