CITY of ORONO <br /> � ti <br /> '� RESOLUTION OF THE CITY COUNCIL <br /> . �L`q 4��'G " NO. � �. � 4.� .� <br /> � kESH� � . �. � <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br /> Minnesota: <br /> FINDINGS <br /> 1. This application was reviewed as Zoning File #2390. <br /> 2. The property is located in the LR-1B, Zoning District, where 1 acre is the <br /> minimum lot area. The property consists of .33 acres or 14,663 sq. ft. <br /> 3. The Planning Commission reviewed this application on August 17, 1998 and <br /> recommended approval on a vote of 4 to 2. <br /> 4. The Planning Commission made the following findings of fact: <br /> • . A. The subject lot does not meet lot width or lot area requirements. <br /> B. This properiy is allowed to have 1,978.25 sq. ft. (25%) of the total lot <br /> azea in the 75-250' setback in hardcover. The City Council determined <br /> per Resolution No. 3926 that the total amount of hardcover to be located <br /> within the 75-250' setback shall be reduced by the amount of existing <br /> hardcover (1,320.75 sq. ft.) in the 0-75' setback. <br /> C. A portion of the yard between the house and the street is located in a <br /> flood plain area. <br /> 5. The City Council finds that the conditions existing on this property are peculiar <br /> . , to it and do not apply generally, to other property in this zoning district; that <br /> , <br /> � � granting the variance would not adversely affect tra�c conditions, light, air nor <br /> pose a fire hazard or other danger' to neighboring properry; would not merely <br /> serve as a convenience to the applicants, but is necessary to alleviate a <br /> demonstrable hardship or difficulty; is necessary to preserve a substantial <br /> property right of the applicants; and would be in keeping with the spirit and <br /> intent of the Zoning Code and Comprehensive Plan of the City. <br /> • Page 2 of 5 <br />
