W. <br />City of OR ONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 1181 <br />DETERMINING THAT SERVICE <br />WILL BE PROVIDED TO VACANT PROPERTY LOCATED <br />ON WEST FERNDALE ROAD KNOWN AS PORTIONS OF <br />LOT 6, NORTH SHORE COTTAGE ACRES T-A MmNBTONKA <br />WHEREAS, the City of Orono is a municipal corporation organized <br />and existing under the laws of the State of Minnesota; and <br />WHEREAS, Sewer Project 80-1 was initiated by the City to solve <br />existing on -site sewage treatment problems in the Minnetonka Bluffs -West <br />Ferndale area, within which the following legally described property is <br />located: <br />PINS# 02-117-23-0007 <br />That part of Lot 6, North Shore Cottage Acres Lake Minnetonka <br />lying northwesterly of a straight line parallel with the <br />extreme southeasterly lire of Lot 6 running through a point <br />in the northeasterly line of said lot a distance 40 ft. <br />northwesterly from the most easterly corner thereof. <br />PINS# 02-117-23-0011 _ <br />The northeasterly 25 feet of the northwesterly 25 feet of <br />Lot 9 North Shore Cottage Acres Lake Minnetonka; and <br />WHEREAS, said parcel is under single separate ownership not <br />owned in common with any other abutting or bearby properties; and <br />WHEREAS, all adjacent lots are occupied or are considered as <br />designated wetlands; and <br />WHEREAS, the total area of the parcel is approximately 3.0 acres, <br />of which approximately 0.6 acres is dry buildable land according to all <br />information the City has available, as compared to the existing zoning <br />regulation requiring 2.0 acres per building site; and <br />WHEREAS, said parcel is not buildable without one or more <br />variances from the existing zoning code; and <br />WHEREAS, construction of a single family residence on the parcel, <br />if done according to all zoning performance standards, would not be contrar <br />to the intent of the Cora unity Management Plan; and <br />WHEREAS, failure to provide sewer service would make the parcel <br />unbuildable because of insufficient room to provide for house, well, and <br />primary and future septic system dretinfield; and <br />WIIERF.AS, sewer will he available in the street or right-of-way <br />,idjacent to the property upon completion of sewer project 80-1, <br />PAGE 1 OF 2 <br />
