Previous variances were granted in 1995 for hardcover in the 0'-75' setback. See Exhibit J, <br />Resolution #2072. The applicant is not requesting variances to install additional hardcoyer. The <br />proposed new residence requires a variance to keep existing hardcover in the 0'-75' setback and <br />to reduce by 2.5 sq. ft. the amount of hardcover in the 75'-250' setback. <br />STATEMENT OF HARD SHIP <br />The applicant has provided a statement in Exhibit C. <br />Criteria for Determining Undue Hardship <br />I. The property in question cannot be put to a reasonable use if used under conditions <br />allowed by the official controls. <br />There is an existing residence on the property and a guest house. The applicant will <br />need to provide testimony as to the reasonable use of the existing structure. <br />2. The plight of the landowner is due to circumstances unique to his property not created <br />by the landowner. <br />The plight of the landowner is created by the shape of the lot, the zoning lot's location <br />on a peninsula, the topography and mature trees and the desire to construct a new <br />residence at the proposed residence. <br />3. The variance, if granted, will not alter the essential character of the locality. <br />The zoning lot will remain residential, however, this structure is larger than the existing <br />structure when viewed from the lakeshore. <br />4. Economic considerations alone shall not constitute an undue hardship if reasonable <br />use for the property exists under the terms of this chapter. <br />Economic factors are not a consideration with this application. <br />5.
