The City Council finds that the combination of Lots 64 and 65 to become <br /> redesignated Record Lot 15 is still less than the minimum lot size required for <br /> new lots in the RS District, but that this Record Lot is being used and/or may <br /> be used in the future for any permitted use in the RS District without adverse <br /> effect upon public health, safety or welfare. <br /> 11. The Cit3- Council finds �,.hat the conditions Pxisti.ng on trss pro�,erty are peculiar <br /> to it and do not apply generally to other property in this zoning district; that <br /> granting the variance would not adversely affect traffic conditions, light, air nor <br /> pose a fire hazard or other danger to neighboring property; would not merely <br /> serve as a convenience to the applicant, but is necessary to alleviate a <br /> demonstrable hardship or difficulty; is necessary to preserve a substantial <br /> property right of the applicant; and would be in keeping with the spirit and <br /> intent of the Zoning Code and Comprehensive Plan of the City. <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon one or more of the above findings, the Orono City Council hereby <br /> grants approval for the redesignation of Big Island Record Lot 15 as being solely comprised <br /> of Lots 64 and 65, Morse Island Park; and further grants a lot area variance for said Record <br /> Lot 15 based on the above findings and subject to the following conditions: <br /> 1. The approvals granted within this Resolution rely on the applicants' acquisition <br /> of Lot 65 and shall take effect only upon the applicants' successful legal <br /> co�nbinatie:: �f Lc�t� 54 w.nd �a5. ' - <br /> 2. Granting of this variance means that Record Lot 15 may be used for one-family <br /> seasonal recreational use without a structure; or a single new seasonal dwelling <br /> may be built; or an existing seasonal dwelling may be used, improved, added <br /> onto, or replaced; all without requiring further City Council review of lot size, <br /> but subject to strict compliance with all building pernut, setback, hardcover, on- <br /> site sewage treatment and other performance standards for development in the <br /> RS district. <br /> Page 4 of 6 <br />
