CITY of ORONO <br />RESOLUTION OF T~e9c~TY COUNCIL <br />NO. _______ _ <br />A RESOLUTION <br />AMENDING RESOLUTION NO. 5860 <br />RENEWING THE VARIANCES APPROVED IN FILE NO. 09-2481 <br />AND ADDING HARDCOVER CALCULATION <br />FILE NO, H) .. 3,131 <br />WHEREAS, NICHOLAS J. KOZLAK and JODEEN A. KOZLAK <br />(hereinafter "Owners") are the owners of the property located at 1635 Bohns Point Road <br />within the City of Orono (hereinafter "City") and legally described as: Tract B, Registered <br />Land Survey No. 565, files of the Registrar of Titles, Hennepin County, Minnesota <br />(hereinafter "the Property"); and <br />WHEREAS, on August 24, 2009 the City Council of the City of Orono <br />adopted Resolution No. 5860 granting the Property average lakeshore setback, lakeshore <br />setback, structural coverage, and hardcover variances so that additions to the existing <br />residence could be constructed. The approval remained valid if a building pennit for the <br />residence was issued by August 24, 2010; and <br />WHEREAS, since a building permit has not been issued the Owners have <br />made application to the City to renew the approval, with no change in the plans; and <br />WHEREAS, Resolution No. 5860 was inadvertently recorded without the <br />hardcover summary as part of Exhibit A. <br />WHEREAS, after due published notice and mailed notice in accordance with <br />Minnesota Statutes and the Orono, Minnesota, City Code, the Orono Planning Commission <br />held a public hearing on July 19, 2010, at which times all persons desiring to be heard <br />concerning this application were given the opportunity to speak thereon. Immediately <br />following the public hearing the Planning Commission recommended approval of the <br />application by a vote of 5 -0. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />Minnesota that Resolution No. 5860 is amended to change the deadline for obtaining a <br />building permit to August 24, 2011 and to add the hardcover summary attached as Exhibit A <br />as the second and third pages of Exhibit A to Resolution 5860. Resolution No. 5860 <br />otherwise remains in effect. <br />Page 1 of2
