Box 66 <br />Crystal Bay, Minnesota 55323 CITY OF, ORONO <br />Re: Jack Rhode <br />Gentlemen: <br />It has been over 27 months since the Orono <br />City Council passed Resolution No. 851 granting Jack Rhode <br />the variances necessary to build a home on the lot commonly <br />known as 1410 Bohn's Point Road and aver three years since <br />the matter was first heard by the council. For 13 months of <br />that period, both Orono and Mr. Rhode were embroiled in the <br />decker lawsuit regarding the validity of the variances. <br />After that hurdle was crossed, Mr. Rhode still faced the <br />prerequisite imposed by Orono of dealing with the Hannah - <br />Stewart easements which purportedly cross over his property <br />and which the council found invalid in Resolution 851. <br />Negotiation proved fruitless and on March 2, 1979, Mr. Rhode <br />commenced a lawsuit seeking removal of th( easements. A <br />calendar motion was brought resulting in an early trial <br />Date. Extensive briefs were fill-' bT both sides and Judge <br />Levy did not te.?rh her (:•_ -isiol )ct(Aher 17, 1979. "he <br />ruled contrary to Resolution 851 held the easements tL> <br />be valid. A motion for an amender' Accision, immediately <br />made by Mr. Rhode, was denied but not until January 25, <br />1980. Mr. Rhode then appealed to the nesc:I.a Supr,me <br />Court. <br />
