City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. /2 /.-;_�_ �_ <br />2. An open, unscreened, unroofed, unenclosed deck <br />or patio not to exc•ec:d 30 inches in height above <br />the ground at any point may be constructed <br />according to City ordinances between the house <br />and the 75 ft. setback line from Lake Minnetonka, <br />provided the total lot hardcover does not exceed <br />the maximum 5,520 sq. -t. as approved in :io. 2 <br />above. <br />4. That if the interpretation of average lakeshore setback <br />line as made in No. 3 above should be found to require <br />a variance from Section 34.202, that such a variance shall <br />be and hereby is granted finding no opposition of the <br />Lauers, a hardship of unusual lot configuration compared <br />to the location of the shoreline and to the Becker and <br />Lauer houses, and that such a location behind line D-D <br />'does in fact adequately protect the sight lines and property <br />values of the Becker property. <br />5. The above variances are contingent upon and shall not be <br />effective until the existing carriage house is removed <br />at Mr. Rhode's expense from the property and execution <br />and filing of the document relating to the use of docks <br />on the Rhode lot as set forth in the findings of facts. <br />This document must be recorded before the City staff is <br />authorized to issue ar;_: building permit for this lot. <br />6. The City Council hereby finds that the variances shall be <br />denied and will be considered to be invalid unless `.he <br />above items are completed to the satisfaction of the City <br />prior to the granting of a building permit, and variances <br />would have been denied except for Mr. Rhode's agreeing <br />in writing to the provisions of this Resolution. <br />7. This variance approval ::Nall terminate and expiry one <br />year from the date of City Council adoption of this <br />Resolution, consi3teut with the provis_ons of Section <br />32.371, unless all the conditions of tnis approval have <br />been mot and a building permit has been applied for in <br />compliance with this approval. <br />PAGE OF 1� <br />
