TO: Jim Cosby, City Administrator <br />FROM: Dexter Marston, Zoning Administrator <br />DATED: May 10, 1974 <br />SUBJECT: Variance - From the 75' Setback Requirement <br />PETITIONER: Maurice McCaffrey <br />LOCATION: 1053 Fernda!e Road West <br />STAFF REPORT: Mr. McCaffrey first got in touch with the City of Orono regarding <br />a permit to fill in the basement of a house that was raised. At that time, the <br />CiTy of Orono or the Minnehaha Watershed District had a 75' setback requirement. <br />When the Watershed District adopted its 75' setback from the lake, I informed <br />Mr. McCaffrey that he would have to get a variance from the Watershed District. <br />Enclosed you will find a letter from the Watershed District confirming the <br />fact that Mr. McCaffrey was granted a variance for the location of his home. <br />Since this time, the City of Orono has adopted its own 75' setback require- <br />ment, and Mr. McCaffrey was not informed of that until just recently. <br />Normally, a petitioner ',o requests a variance is referred to the Planning <br />Commission, but Mr. McCaffrey has asked if the Council will act on ties matter <br />without the Plarning Commission's recommendation since he has already received <br />the approval of the P-linnehaha Creek Watershed District, and has made plans to <br />start construction of a home the week of May 20, 1974. In addition, Mr. McCaffrey <br />needs a variance from the moratorium. Since Mr. McCaffrey is planning to construct <br />a sealed system, there should be no prob!em with granting this 9riance. <br />
