, <br /> g,, 0.4i. <br /> 0 0 <br /> .1/4:-4. , � CITY of ORONO <br /> 1, MA Woe I �o ' RESOLUTION OF THE CITY COUNCIL <br /> 4 ESH°4 N0. <br /> A RESOLUTION GRANTING <br /> VARIANCES TO <br /> MUNICIPAL ZONING CODE <br /> SECTION 10.56, SUBDIVISION 16 (C) (6) <br /> FILE #2419 <br /> WHEREAS, William Hoeft and Anastasia Hoeft (hereinafter "the applicants") <br /> are owners of the property located at 1725 Bohns Point Road within the City of Orono <br /> (hereinafter "City") and legally described as follows: <br /> Lots 4 and 5, Auditor's Subdivision No. 349, Hennepin County, Minnesota <br /> (hereinafter "the property"); and <br /> WHEREAS, after due published notice and mailed notice in accordance with <br /> Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning <br /> Commission held a public hearing on September 28, 1998, at which times all persons desiring <br /> to be heard concerning this application were given the opportunity to speak thereon; and <br /> WHEREAS, the applicants have applied to the City for variances to Municipal <br /> Zoning Code Section 10.56, Subdivision 16 (C) (6) to permit the construction of a residence <br /> encroaching 35' into the average lakeshore setback and a pool terrace encroaching 40' into the <br /> average lakeshore setback where no encroachment is normally allowed. <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br /> Minnesota: <br /> FINDINGS <br /> 1. This application was reviewed as Zoning File #2419. <br /> 2. The property is located in the LR-1B, One Family Lakeshore Residential Zoning <br /> District, where 1 acre or 43,560 sq.ft. is the minimum lot area. The property <br /> consists of 2.92 acres or 127,382 sq.ft. <br /> Page 1 of 4 <br />
