ty of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. <br />A) The ramp and boat located within 20 feet of the shore- <br />line of Long Lake will have no negative impact on the lake <br />views of the adjacent neighbors because of the existing <br />topograp'1y, natural vegetation and curve of the shoreline. <br />B) The existinej lakebed does not provide adequate support <br />for a boat lift and because of the soft silt lakebed, <br />mooring at a dock is not acceptable because of constant <br />damage to boat. <br />C) The alternative of dredging af,.d filling the iakebed is <br />riot environmentally sound nor is it practical in light of <br />the need continually to maintenance dredge. <br />4. The City Council has consi.lered this application including <br />the findings and recommendations of the Planning Commission, <br />reports by City staff, comments by the applicant and the effect <br />of the proposed variance on the health, safety and welfare of the <br />community. <br />5. The City Council finds that the conditions existing on this <br />property are peculiar to it and do not apply generally to other <br />property in this zoning district; that granting the variance <br />woula not adversely affect traffic conditions, light, air nor <br />pose a fire hazard or other danger to neighboring property; would <br />not merely serve as a convenience to the applicant., but is <br />necessary to alleviate a demonstrable hardship or difficulty; is <br />necessary to preserve a substantial. property right of the <br />apr,licant; and would be in keeping with the spirit and intent of <br />the Zoning Coda- and Comprehensive Plan of the City. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the findings cited above, the <br />Orono City Council hereby grants a variance to the Municipal ?oning <br />Code Section 10.22, Subdivis=ons 1 & 2 to permit the installation of a <br />ramp within 75 feet of the shoreline of Long Lake at the property <br />located at 1125 Spring Hill. Road, subject to the following conditions: <br />1. The ramp structure may never be enclosed with a <br />superstructure nor a canopy. <br />2. Applicant must obtain a building permit from the City of <br />Orono prior to installation. <br />Page 2 of 4 <br />
