TO: <br />Mayor <br />and City Council <br />r� <br />FROM: <br />Mark <br />Bernhardson, City <br />Adm'_nistratov <br />DATE: <br />April <br />3, 1S87 <br />SUBJECT: Access to 4545 Wayzata Boulevard <br />ISSUE - Update of Council regarding progress or above stated <br />maFFer. <br />INTRODUCTION - At your 'last meeting a <br />request <br />was made <br />to the <br />Council for the Council to undertake the <br />appropriate condemnation <br />procedures to make the crossing of the <br />railroad <br />tracks a <br />public <br />crossing. This was requested in order <br />that the <br />property <br />at the <br />above stated address togetn,?r with three other <br />properties <br />would <br />have an access satisfactory to the title <br />insurance company <br />for <br />mortgage purposes. <br />DISCUSSION - Following the meeting on March 30, 1987, the <br />Slaught_�rs were directed to see if they could obtain another <br />easement that would not involve crossing the railroad by the <br />property owners to the north and west or property owners to the <br />-ast. Such an easeme— would not necessarily have ,•) he <br />constructed as they coula still use the private easement .ac-oss <br />the railroad tracks, however, tt.is would give them legal access <br />to the property and would hopefully sat_isify the title insurance <br />company. It is our underst,.n9inq the Slaughters are currently <br />exploring these possibilities and as such this may obviate the <br />need to readdress the issue of crossing railroad. <br />RECOMMENDATION - It is recommended that the Council table this <br />it until April 27, 1987 at which time the status can b� <br />reviewed to see what, if any, action on the part of the City is <br />appropriate in this matt-r. <br />PROPOSED MOTION - Moved by , seconded by , to accept staff's <br />information regarding this-Tssue and the item be tabled until <br />April 27, 1987 to review furncc- r progress on the matte:.
