Zoning File #1120 <br />March 4, 1987 <br />Page 2 of 2 <br />:roposal: <br />Applicant is proposing to remove an existing 14'xl6' shed near the <br />road and replace it with a 221x 24' garage. This would give him the <br />opportunity to locate the garage to meet the 10' side and 10' street <br />setbacks. He is requesting a variance to keep the garage 2' from the lot <br />line and 2' from the street, a slightly better setback situation than the <br />existing but not meeting the code standards. <br />Applicant's stated hardship is the slope of the lot to the southeast; <br />if the garage is placed closer to the center of the lot some additional <br />fill is needed to accommodate a flat driveway apron. Staff does not see <br />this as a valid hardship since the entire frontage of the lot only varies a <br />foot or two. However, if the garage is moved to the 10' street setback <br />line, a standard driveway will (in staff's estimation) bring applicants 75- <br />250' hardcover over the 258 limit. Either way, a garage apron with <br />backup area provided on the property (as required by code) would likely <br />exceed the 258. <br />Note that the 2 sketches have been supplemented by staff to show the <br />BBq grill, the fire hydrant, an existing oak tree, a carving of Bucky <br />Badger, and an anticipated minimal driveway apron based on the specific <br />garage location. <br />Discussion: <br />Staff feels that because this portion of Concordia Street has minimal <br />traffic, and since Eagerness Point has essentially reached full <br />development, it is not critical that a backup apron be provided. <br />The Public Works Director has indicated that for snow removal and <br />storage purposes, the garage should be required to meet the 10' setback. <br />From a fixe safety standpoint, the 10' setback to the hydrant should also <br />be met if feasible. <br />The garages on either side are 8' and 17' from the street lot line, <br />respectively. <br />An existing oak tree next to the street would %eve to be removed to <br />accommodate the proposed garage. Staff has no information as to the <br />condition of this tree, however, it appears to be within applicant's <br />property. <br />Staff Ssoommeadation: <br />Staff does not see any real hardship to justify the variances. <br />Perhaps applicant has additional reasons why the variances should be <br />granted. <br />Staff suggests that a 2s hardcover variance in appropriate to grant in <br />order to accommodate a garage on the property, Tn order to keep the 10' <br />required street setback. we would also recommend that a side setback of no <br />less than 5' be required in order to maintain adquate fire protection <br />setbacks, both from the hydrant and from the neighboring garage. <br />
