Planning Commission Vote and Comment: <br />The Planning Commission considered the application at its August 18th meeting (Meeting Video). <br />Following the public hearing, the Commission requested that the applicant submit additional <br />information, including a plan to address the identified encroachments. The application was <br />subsequently tabled to the next Planning Commission meeting to allow time for submission and <br />review of the requested materials. <br />The Commission requested the additional information to provide clarification regarding existing <br />site conditions that cannot be adequately represented through photographs or simplified site plans. <br />To resolve the outstanding issues and ensure the record contains accurate information for <br />permitting purposes, the applicant was directed to provide: <br />• An updated Certificate of Survey for the property; and <br />• A current existing -conditions hardcover calculation worksheet, prepared and certified by <br />your surveyor; and <br />Amended plans for the patio and walls. <br />Because the requested information has not been provided, the application has not been brought <br />back before the Planning Commission for consideration. <br />Public Comment: <br />Multiple public comment submissions were provided before and after the public hearing. The <br />public comments are combined and attached as Exhibit B. <br />6. Staff Recommendation: <br />Staff established a revised submittal deadline of February 2nd to allow the applicant sufficient <br />time to provide the required survey and revised plans so the application could proceed to the <br />February Planning Commission meeting. The applicant's extension of the statutory review period <br />expires on March 20th. As no materials have been submitted to date, there is insufficient time <br />remaining to schedule and complete both a Planning Commission review and subsequent City <br />Council action before the extension expires. <br />Accordingly, staff recommends that the City Council consider a motion to deny the application <br />and direct staff to prepare a resolution of denial for formal action at the March 9th City Council <br />meeting. <br />COUNCIL ACTION REQUESTED <br />Make a motion to deny application LA25-000036 and direct staff to prepare a resolution with findings <br />for denial. <br />Exhibits <br />A.
