AGENDA ITEM <br />Date: February 23, 2026 <br />Item: 13 <br />Title: LA26-000004, 3590 North Shore Drive, Variances - Resolution 7667 <br />Presenter: Melanie Curtis, Planner <br />Section: Consent Agenda <br />Purpose: <br />This application contemplates the following variance approvals to support the construction of a <br />new home on the property: <br />1. Lot Area Variance, <br />2. 75-foot Lake Setback Variance (building and hardcover), <br />3. Average Lakeshore Setback Variance, and <br />4. Rear Yard and Side Yard Setback Variance. <br />2. MN§15.99 Application Deadline: <br />This application was received and considered to be complete on January 21, 2026. The 60-day <br />review timeline will expire on March 22nd. <br />3. Background: <br />The existing home is nonconforming with respect to the lake, average lake, rear/street, and side <br />setbacks and is out of compliance with FEMA's low -floor requirements. The applicant is <br />proposing to construct a new two-story home in the same location. The basement of the proposed <br />home will be elevated 1.7 feet higher than the existing home to meet the floodplain low floor <br />regulation. The vacant property to the west is owned by Hennepin County. <br />4. Planning Commission Vote and Comment: <br />The Planning Commission held a public hearing and reviewed the application at its regular <br />meeting on February 17th. After a discussion, the Commission voted 4 to 0 in favor of a motion to <br />recommend approval as applied, conditioned upon the staff recommendation, which included <br />planting two trees in the lake yard. <br />Public Comment: <br />The DNR reviewed the proposed development and recommended that the owner plant 2 trees in <br />the lake yard to screen the massing of the new second story from the lake. The acknowledgement <br />form and a statement in support were received from the neighbor at 3580 North Shore Drive (both <br />are attached as Exhibit D). <br />6. Staff Recommendation: <br />Planning Staff recommends approval as proposed, conditioned on the applicant agreeing to plant a <br />minimum of two native trees placed within the lake yard to provide screening of the home from <br />the lake. The applicant has agreed to plant two trees within the 75-foot shore setback area of the <br />property. The plans should be provided with the building permit application and will be reviewed <br />by staff at the time of permitting. <br />COUNCIL ACTION REQUESTED <br />Council should make a motion to adopt Resolution 7667. <br />59 <br />
