AGENDA ITEM <br />Date: February 23, 2026 <br />Title: LA26-000001, 860 Brown Road South, Variance - Resolution 7666 <br />Presenter: Matt Karney, Planner <br />Section: Consent Agenda <br />Item: 12 <br />Purpose: <br />The applicant requests an average lakeshore setback variance to construct a new residence on the <br />property. <br />2. MN§15.99 Application Deadline: <br />The application was made on January 20, 2026, and deemed complete on January 26, 2026. The <br />60-day review period is to expire on March 27, 2026. <br />3. Background: <br />The applicant proposes a new home on the property, where the existing home was demolished in <br />2024. The fourteen (14) acre property consists of a large wetland area, and contains the ordinary <br />high-water level (OHWL) of Lake Minnetonka, making this property and its neighbors lakeshore <br />lots. The proposed home is located within the average lakeshore setback. It will not impact the lake <br />views for the neighbors due to the orientation of the lot and the location of the proposed home. <br />Link to Planning Commission packet. (Application Materials Found Here) <br />4. Planning Commission Vote and Comment: <br />On February 17, 2026, the Planning Commission held a public hearing and discussed the requested <br />variance. Following the public hearing, the Commission voted 4 to 0 to recommend approval of <br />the variance as recommended by staff. <br />Link to Planning Commission video. <br />5. Public Comment: <br />No public comments have been received. <br />6.
