Staff <br />recommends denial of the setback variances and approval of the CUP for the retaining walls with conditions and <br />modifications as noted herein. <br />Planning Commission should consider one or more of the following motions: <br />1. Approval as applied. <br />Denial of the application as applied. Provide direction to the applicant. <br />Partial approval, including: <br />a. Approval of the conditional use permit for the retaining walls within the lake yard, with conditions for <br />screening and wall modifications to meet the 5-foot side yard setback, as necessary. <br />b. Denial of the setback variances for the improvements near the home and the lake slope walls and the <br />patio. To accommodate a safe landing and access to the area, it may be necessary to modify the patio and <br />landing to meet the 7.5-foot side setback. <br />160 <br />
