Commencing at the southeast comer of Lot 1, Block 1, Beth and Bridget; thence . <br />on an assumed bearing of North 89 degrees 40 minutes West along the southerly <br />line of said Lot 1 a distance of 305.00 feet~ thence South 67 degrees .20 minutes <br />West a distance of22.00 feet to the point of beginning of the line to be described; <br />thence North 55 degrees ·40 minutes West to the shore of Lake Minnetonka and <br />said line there ending (said scenic view casement is depicted on Exhibit B which <br />is attached hereto solely for the purpose of depicting the same). <br />No buildings. fences or other structures (including docks) shall be constructed or placed within <br />the scenic view area, and the owner of the Southerly Parcel may enter the scenic view area to cu(i <br />trim or otherwise remove trees, shrubs and plants which interfere with the view from the <br />Southerly Parcel over the scenic view area to Lake Minnetonka. <br />ARTICLE.3 <br />Nuisances and Animals <br />Section L Nuisances. No noxious or offensive activities shall be carried on upon any <br />Parcel, nor shaU anything be done thereon which may be or may become an annoyance or <br />nuisance to any Parcel owner. <br />Section 2. Animals. No animals, livestock or poultry of any kind shall be raised, bred or <br />kept on any Parcel, except that dogs, cats or other common oousehold pets may be kept, so Jong <br />as they are not kept, bred or maintained for any commercial purposes, and are maintained in <br />accordance with applicable law and ordinances. <br />ARTICLE4 <br />Garbage and Refuse Disposal <br />No Parcel shall be used or maintained as a dumping ground for rubbish. Trash, garbage <br />or other waste shall not be kept except in sanitacy containers out of view from roads and adjacent <br />houses. No outside garbage and/or refuse burning or burning apparatus shall be pennitted. <br />ARTICLES <br />Outdoor Storage <br />Section 1. Outdoor Storage. There shall be no permanent outside storage of any type of <br />vehicle or recreational equipment, including, but not limited to, camping trailers, motor homes, <br />snowmobiles, motorcycles or motorbikes. For purposes of this Se·ction "permanent" shalf mean <br />storage for more than a four week period. Any storage of any type of watercraft shall be either at <br />a boat slip at a dock located and installed in confonnance with ordinances, rules and regulations <br />of the Department of Natural Resources, Lake Minnetonka Conservation District and the City of <br />Orono, or only on the northerly one-half of said Northerly Parcel, or only on the southerly one⢠<br />half of said Southerly Parcel, measuring the said one-half from the mid-point of the easterly line <br />of each of the said Parcels to the mid-point on the shore of Lake Minnetonka of each of the said <br />Parcels, equidistant from the respective Jot lines of each Parcel. <br />3 <br />Doc# l8741U6\I
