City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 2294 <br />OF <br />••• • <br />A RESOLUTION APPROVING A <br />METES AND BOUNDS SUBDIVISION <br />OF A LOT LINE RERRRAHGEMEHT <br />FOR PAOL W. BOYRE AT <br />793-795 NORTH FERNDALE ROAD <br />FILE NO. 1212 <br />WHEREAS, the City of Orono is a municipal corporation organized <br />and existing under the laws of the State of Minnesota; and <br />WHEREAS, the City Council of the City of Orono hii adopted <br />subdivision regulations for the orderly, economic and safe development of <br />land within the City; and <br />WHEREAS, the City Council has considered the application for a <br />subdivision by Paul W. Boyke, (hereinafter "the subdivider") of a property <br />legally described on the Certificate of Survey by Mark S. Gronberg dated <br />October 30, 1987 and attached to this Resolution as Exhibit A; and <br />WHEREAS, the subdivider has completed all requirements of the <br />City for metes and bounds subdivision for division and combination <br />purposes, including: <br />1. Dedication to the City of a Road & Utilities Easement over Parcel <br />D. <br />2. Dedication to the City of a Drainage & Utilities Easement over <br />portions of Parcels B and C. <br />3. Execution of a "Declaration of Private Road Easerent and <br />Declaration of Covenants for Maintenance of Same" over Parcel D. <br />NOW, THEREFOnE BE IT RESOLVED, that the City Council of the City <br />of Orono hereby approves the metes and bounds division for Paul W. Boyke <br />according to the legal descriptions shown on the Certificate of Survey by <br />Mark S. Gronberg, dated October 30, 1987 and attached to this resolution <br />subject to the following conditions: <br />1. Upor approval of the subdivision by the City Council of Orono, the <br />owner of Parcel A as described in tl.e Certificate of Survey referenced <br />above must apply to the City for legal combination for tax purposes <br />with Parcel B as described in that same survey. <br />2. This resolution, the attached Certificate of Survey, and the above <br />referenced documents shall be filed with the Hennepin County <br />Recorder's Office on or before May 9, 1.988. <br />Page 1 of 2 <br />
