The property owner proposes to use the property in a reasonable manner not permitted <br />by the Zoning Chapter. <br />Response: The zoning ordinance permits the use of a single family home and accessory uses, such <br />as swimming pools. The previous home and outdoor amenities were located within the 150-foot <br />setback, and the newly constructed home and site amenities are intended to be situated on the <br />property in a similar manner. It is reasonable to allow a similar use of the property as what previously <br />existed and what was previously approved. <br />2. The plight of the landowner is due to circumstances unique to his property not created <br />by the landowner. <br />Response: The existing conditions of the lot, which included the topography, vegetation, and septic <br />mound location created difficulties initially in the site planning process. Since the new home has been <br />under construction, it became evident that the pool would create less of a site impact in the newly <br />proposed location, especially as the proposed location will have less potential impact around an <br />existing septic system. <br />3. The variance, if granted, will not alter the essential character of the locality. <br />Response: The proposed new pool location will not alter the essential character of the locality. It is <br />an important goal of the project to be consistent with the context in terms of architectural <br />compatibility, scale, and maintaining the character of the property. <br />4. Economic considerations alone do not constitute practical difficulties if reasonable use <br />for the property exists under the terms of the Zoning Chapter. <br />Response: There are no economic considerations as part of this proposal. <br />S. Practical difficulties include, but are not limited to, inadequate access to direct sunlight <br />for solar energy systems. Variances shall be granted for earth -sheltered construction as <br />defined in Minnesota Statutes, Section 1161.06, Subd. 2, when in harmony with this <br />Chapter. <br />Response: The proposed design is an alternative, and we believe an improved, solution to the <br />practical difficulties stated as part of the initial application for this project. These practical difficulties <br />include the topography, the existing vegetation of large wooded areas, the existing house location, <br />and an existing septic mound. <br />6. The Board of Appeals and Adjustments or the Council may not permit as a variance any <br />use that is not allowed under this Chapter for property in the zone where the affected <br />person's land is located. <br />Response: N/A <br />7.
