Consistence with the City of Orono Comprehensive Plan <br />Property Address: 860 Brown Rd Orono, MN <br />PID: 1011723120001 <br />Zoning District: RR-113 <br />Variance Requested: Average Lakeshore Setback Line Waived <br />The applicant is requesting a variance from Orono City Code § 78-1279(6) (as amended by <br />Ordinance No. 313) - Average Lakeshore Setback to allow The proposed new home to comply only with <br />the 75' lake setback from the OHWL and not the "Average Lakeshore (Sightline) Setback". The proposed <br />request is necessary to allow a reasonable use of the property while remaining consistent with the intent <br />of the zoning ordinance and the City of Orono Comprehensive Plan for rural residential. <br />The proposal is consistent with the City of Orono Comprehensive Plan. Areas guided for Rural <br />Residential use, including properties zoned RR-113, are intended for low -density single-family residential <br />development. The proposed project consists of a single-family dwelling located on a 14.064-acre parcel, <br />which is consistent with the Comprehensive Plan's expectations for density and intensity in rural <br />residential areas. <br />The request for an average lakeshore setback variance supports the Comprehensive Plan's goals <br />by allowing reasonable placement of the home in a manner that preserves rural character, respects existing <br />development patterns along the lakeshore—despite the property not being directly on the shoreline of <br />either Tanager lake or Lake Minnetonka —and protects natural resources by maintaining the 75-foot <br />setback from the OHWL and the 35-foot wetland buffer. <br />The proposed placement at 133 feet and 184 feet setback at corners is consistent with, and is <br />greater than, the established setback pattern of adjacent properties and does not increase density or <br />intensity beyond what is typical for the area. Approval of this variance allows the structure to align with <br />past waivers of the average lakeshore setbacks in the development of Fox Island and other nearby <br />developments consisting of a peninsula feature on the property, while remaining consistent with the <br />Comprehensive Plan's land use and environmental protection objectives. Approval will not impact the sight <br />line or view of the immediate neighbor to the north or applicable neighbor to the south which create the <br />average lakeshore setback line. <br />Conclusion <br />For the reasons stated above, the requested variance meets the City of Orono and Minnesota <br />statutory criteria for practical difficulties. The variance allows a reasonable use of the property, is <br />consistent with the Comprehensive Plan, maintains neighborhood and rural character, respects <br />environmental protections, and aligns with the intent of the zoning ordinance.
