City of (_)RONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. <br />A RESOLUTION GRANTING <br />A VARIANCE TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.28, SUBDIVISION 5 (B) <br />PILE #1105 <br />WIIEREAS, Thomas and Joanne Hitch (hereinafter "the <br />applicant") has an interest in the property located at 1180 Lyman <br />Avenue within the City of Orono (hereinafter "City") and legally <br />described as follows: <br />That part of Tract A lying Easterly of the following described <br />line: Beginning at the most Northerly corner of said Tract A; <br />thence Southerly to a point on the south line of said Tract A, <br />distant 120 feet West from .=he Northeast corner of Tract B, and <br />there terminating; all within Registered Land Survey No. 1067, <br />Files of the Registrar of Titles, County of Hennepin, EXCEPT, <br />that part of Tract A, Registered Land Survey Nu. 1067, for road <br />purposes, described as follows: That part of said Tract A lying <br />within the circumference of a c-rc=.c having a radius of 50 feet, <br />the center of said circle being the Northeast corner of Tract B, <br />said registered land survey (hereinafter "the property"); and <br />WHEREAS, the applicant has applied to the City for a <br />variance to Municipal Zoning Code Section 10.2F, Subdivision 5 (B) to <br />permit the construction of a new residence on a lot with 65,153 square <br />feet in area instead of the required 87,120 square feet. <br />Minnesota: <br />NOW, TIiEREFORE, BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />1. This application was reviewed as Zoning File #1105. <br />2. The property i.s located in the RR-1B Single Family Rural <br />Residential Zoning District. <br />3. The Orono Planning Commission reviewed this application on <br />Fe;)ruary 17, 1987, and recommended approval of the proposed <br />variance based upon the Following findings: <br />A) This parcel was created prior to the creation of the RR- <br />3-B zoning district. <br />B) No additional land is available. <br />Page 1 of 4 <br />
