ORDINANCE NO._, THIRD SERIES <br />AN ORDINANCE <br />AMENDING THE ORONO, MINNESOTA, CITY CODE <br />AND AMENDING THE OFFICIAL ZONING MAP <br />BY REZONING <br />OUTLOT A NAVARRO <br />FILE #09-3401 <br />Council <br />Exhibit A <br />WHEREAS, the City of Orono is a municipal corporation organized and existing <br />under the laws of the State of Minnesota; and <br />WHEREAS, on February 14, 1983, the City of Orono, owner of Outlot A Navarro, <br />and Robert H. Harding, owner ofland needed for the widening of Blaine A venue and construction of <br />Lyric Avenue to serve the Navarro Addition, entered into an agreement to exchange these properties; <br />and <br />WHEREAS, a condition of this agreement was the City rezone Outlot A to B-1 <br />Retail Sales Business from Lakeshore Residential 1 C-1; and <br />WHEREAS, the property exchange was completed; and <br />WHEREAS, after due published notice and mailed notice in accordance with <br />Minnesota Statutes and the Orono Code, the Orono Planning Commission held a public hearing on <br />April 20, 2009 at which times all persons desiring to be heard concerning the proposed rezoning of <br />Outlot A were given the opportunity to speak thereon; and <br />WHEREAS, on April 20, 2009, the Orono Planning Commission by a vote of 4 to 0 <br />recommended approval of the rezoning. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ORONO <br />DOES HEREBY ORDAIN: <br />Section 1. The Orono, Minnesota, City Code is amended by amending the official zoning map <br />and zoning district boundaries for the land in Hennepin County, Minnesota described as follows: <br />Outlot A Navarro <br />Said land is hereby rezoned from Lakeshore Residential 1 C-1 to Retail Sales Business B-1. <br />Section 2. This ordinance shall be effective upon approval and publication. <br />Page 1 of2
