This temporary easement shall remain <br />in effect until the date of closing. <br />10. Temporary Construction Easement. Harding hereby grants <br />and relinquishes onto the City, over, across and under Property A <br />and Property B, the right, privilege and easement to use and <br />occupy temporarily the property for the accommodation of <br />construction equipment, materials and excavated earth, to fill and <br />grade soil thereon, to sealcoat the existing parking lot, to build <br />an access limitation onto County Road 15, and other activities <br />described in more detail in Exhibit C attached hereto, and to do <br />anything necessary or useful or convenient for the enjoyment of <br />the easemen£ herein ~ranted. The temporary construction easement <br />shall expire on October 15, li83. Following construction, the <br />City will cause to be removed all machinery, equipment, materials, <br />and supplies from Property Band will leave Property Bin a neat; <br />presentable manner. <br />11. Notice. Any notice given under this agreement shall be <br />deemed given on the date the same is deposited in the United <br />states mail (registered or certified), postage prepaid, addressed <br />as follows: <br />-5-
