CITY of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />5 7 5 6 .NO. ______ _ <br />FINDINGS <br />1. This application was reviewed as Zoning File #08-3362. <br />2. The Property is approximately 0.65 acre in area and 112 feet in width. <br />3. The Property is occupied by the City's Navarre water tower and water <br />treatment facility as well as a small park. The principal building, the water <br />tower and the parking areas on the property do not comply with the required <br />setbacks. <br />4. The Planning Commission reviewed this application on May 19, 2008 and on a <br />vote of 5-0 recommended approval of the conditional use permit and variance, <br />based on the following findings: <br />a. The proposed generator is a reasonable adjunct to the wireless antenna <br />facility. <br />b. The design and location of the enclosure are compatible with the <br />surrounding residential area. <br />c. Most of the structural coverage results from the 7 foot high chain link fence <br />around the water treatment facility. The fence is necessary to secure the <br />facility. <br />d. Because of the limited size of the water treatment facility, there 1s no <br />location for the generator within the fenced area. <br />5. The City Council has considered this application including the findings and <br />recommendation of the Planning Commission, reports by City staff, comments <br />by the applicant and the public, and the effect of the proposed conditional use <br />permit and variance on the health, safety and welfare of the community. <br />6. The City Council finds that the conditions existing on this property are peculiar <br />to it and do not apply generally to other property in this zoning district; that <br />granting the variance would not adversely affect traffic conditions, light, air <br />nor pose a fire hazard or other danger to neighboring property; would not <br />Page 2 of 4
