(17 acres) <br />+600 ' <br />FILE# 07-3279 <br />12 April 2007 <br />Page 1 of 4 <br />Application Summary: The applicant is requesting conditional use permit approval in <br />order to construct an accessory building larger than 500 s.f. as permitted by code. <br />Staff Recommendation: Planning Department Staff recommends approval for <br />construction of one building 2,000 s.f. in size. <br />Pertinent Zoning Ordinance Sections <br />Sec. 78-566. Accessory uses. <br />Within any RS seasonal recreational district, no accessory structure or use of land shall <br />be permitted unless a permitted or conditional use is first established on such land, except <br />as allowed in section 78-564(2). Once a permitted or conditional use exists on any lot or <br />parcel, no accessory structure or use of land shall be permitted except for one or more of <br />the following uses: <br />2. Not more than two accessory buildings used for storage, service or other <br />nonhabitable purpose. No such individual building shall exceed 1,000 square feet <br />in floor area, and the sum of any two buildings on any record lot shall not exceed <br />1,500 square feet in floor area without a conditional use permit. Accessory <br />buildings used as barns or stables shall be subject to this area restriction and to a <br />conditional use permit pursuant to section 78-565(6), including a 150-foot setback <br />from all property lines. <br />Sec. 78-570. Yard and setback requirements. <br />(4) Minimum setback from internal side or rear property line shall be: <br />a. All structures on lots 200 feet or more in width, 50 feet. <br />1
