Lot Area: <br />#03-2955 <br />October 20, 2003 <br />Page 1 of5 <br />Application Summary: Applicant requests the following variances to construct a 3- <br />season cabin: <br />1. Average lakeshore setback variance to construct a home on a property which sits <br />entirely in front of the average lakeshore setback line. <br />2. Lot area variance to allow a cabin to be constructed on a lot on Big Island where the <br />lot is only 2.889 acres in size and 5 acres is normally required. <br />Staff Recommendation: Staff recommendations: <br />1. Approval of the average lakeshore setback variance to allow a 3-season cabin to be <br />constructed on a property which sits entirely in front of the average lakeshore setback <br />line. <br />2. Approval of the lot area variance as the property is a legal lot a record and no structure <br />could be built on the property without a lot area variance. <br />Pertinent Zoning Ordinance Sections <br />Section 78-1279: Placement of structures on lots. Average lakeshore setback. No <br />principal or accessory structure shall be located closer to the lakeshore than the average <br />distance from the shoreline of existing residence buildings on adjacent lots; except that <br />this does not apply to stairways, lifts, landings and lockboxes. Further, the average <br />lakeshore setback shall apply only to classified lakes and shall not apply to tributaries. <br />The average lakeshore setback line shall be a straight line connecting the most lakeward <br />protrusions of the residence buildings on the immediately adjacent lakeshore lots. <br />Section 78-568: Lot area requirements. Within any RS seasonal recreational district, no <br />new lot or parcel shall be created less than 5.0 acres in dry-buildable lot area exclusive of <br />designated wetlands ...
