RESOLUTION OF THE CITY COUNCI� <br /> � �9kESH�4�' NO. � c� � � <br /> WHEREAS, the applicants have applied to the City for a variance to Municipal <br /> Zoning Code Section 10.28, Subdivision 5 (B) to permit a side yard setback variance to allow <br /> a 612 s.f. two stall attached garage to be located 13.9' where 30' is required from the side lot <br /> line. � <br /> � NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br /> Minnesota: � <br /> . FINDINGS <br /> 1. This application was reviewed as Zoning File #2525. <br /> 2. The property is located in the RR-1B Zoning District, where 2 acres or 87,120 <br /> s.f. is the minimum lot area. The property consists of 2.01 acres or 87,410 <br /> • s.f. <br /> 3. The Planning Commission reviewed this application on November 15, 1999 and <br /> recommended approval on a vote of 6 to 0. <br /> 4. The Planning Commission made the following findings of fact: <br /> A. The construction of the garage will not exceed the allowable hardcover <br /> for the 75-250' zone, the total hardcover for this zone after the garage <br /> addition will be 7,694 s.f. (13.4%). . <br /> 5. The City Council fmds that the conditions existing on this property are peculiar <br /> to it and do not apply generally to other property in this zoning district; �that <br /> granting the variance would not adversely affect traffic conditions, light, air nor <br /> pose a fire hazard or other danger to neighboring properry; would not merely <br /> serve as a convenience to the applicants, but is necessary to alleviate a <br /> demonstrable hazdship or difficulty; is necessary to preserve a substantial <br /> property right of the applicants; and would be in keeping with the spirit and <br /> intent of the Zoning Code and Comprehensive Plan of the City. <br /> , Page 2 of 6 <br />
