L� � � � <br /> S <br /> WHEREAS, after due published notice and mailed notice in accordance with <br /> Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning <br /> Commission held a public hearing on April 17, 2000 at which times all persons desiring to be <br /> heard concerning this application were given the opportunity to speak thereon; and <br /> WHEREAS, the applicants have applied to the City for variances to Municipal <br /> Zoning Code Section 10.28, Subdivision 5 (B) to pernut construction of a 816 s.f. second story <br /> addition to the residence 26.5' from the reaz yard property line where 50' is required. <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br /> Minnesota: <br /> FINDINGS <br /> Sl. This application was reviewed as Zoning File #2575. . <br /> � 2. The properry is located in the RR-1B, Rural Residential Zoning District requiring <br /> 2 acres in area. The properry consists of total area of 87,054 s.f. or 1.99 acres. <br /> 3. The Planning Commission reviewed this application on April 17, 2000 and <br /> recommended approval on a vote of 5 to 0. <br /> 4. The Planning Commission made the following findings of fact: <br /> A. The footprint of the residence is not increasing. <br /> B. The residence was constructed prior to current zoning standards. <br /> C. No neighboring residence will be impacted by the 26.5' setback. <br /> 5. The City Council finds that the conditions existing on this property are peculiar <br /> to it and do not apply generally to other property in this zoning district; that <br /> granting the variance would not adversely affect tr�c conditions, light, air nor <br /> pose a fire hazard or other danger to neighboring property; would not merely <br /> • Page 2 of 6 <br />
