City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />• NO. <br />A RESOLUTION GRANTING <br />A VARIANCE TO <br />MUNICIPAL BONING CODE <br />SECTION 10.28, SUBDIVISION 5 (B) <br />FILE #1099 <br />WHEREAS, Carolynne A. Hibbs (hereinafter "the applicant") is <br />the owner of the property located at 2765 Fox Street within the City <br />of Orono (hereinafter "City") and legally described as follows: <br />The west 365 feet of Lot 25, Auditor's Subdivision No. 229, <br />Hennepin County, Minnesota (hereinafter "the property"); and <br />WHEREAS, the zpolicant has applied to the City for a <br />variance to Municipal Zoning Cede Section 10.28, Subdivision 5 (B) to <br />permit the construction of a 2-stcry Seck addition to be located 28 <br />feet from the front !.ot line where a 50 foot front yard setback is <br />normally required. <br />NOW, THEREFORE, BE IT ABSOLVED by the City Council of Orono, <br />Minnesota: <br />d;i ] ( 2*3 <br />1. This application was reviewed as Zoning File f1099. <br />2. The property is located in the RR-115 Single Fam'ly Rural <br />Residential Zoning District. <br />3. The Orono Planning Commission reviewed this application on <br />January 20, 1987, and recommended approval of the propose9 <br />variance based upon the following findings: <br />A) The proposed addition will have no visual encroachment <br />effect on the neighborhood. <br />B) Applicants hardship is the location of the dedicated <br />right-of-way in relation to the actual traveled roadway and <br />the long-term historic use of right-of-way as yard area. <br />0. The City Council has considered this application including <br />the findings and recommendations of the Planning Commission, <br />reports by City staff, comments by the applicant and the effect <br />of the proposed variance on the health, safety and welfare of the <br />coumnity. <br />Page 1 of 3 <br />
