Zoning File #1099 <br />January 7, 1987 <br />Page 2 <br />Septic System Location - <br />A: a result of the survey provided for this application, it was <br />discovered that the applicants drainfield is located within the <br />platted right-of-way. This was recently installed (1986) and the <br />location was approved by City staff based on apparent (but now <br />disproven) property lines. Again, given that this right-of-way <br />is perceived and used as front yard area, and that the City has <br />no current plans to relocate or widen Fox Street, staff <br />recommends that the drainfield be allowed to remain as -is, <br />subject to the applicant executing a hold harmless agreement, so <br />the City would not be liable for damage to the system if in fact <br />the road is widened or shifted in the future. <br />
