Applicant <br />requests a front setback variance to allow a 6' wide 2-story deck <br />addition. <br />At their 1/20/87 meeting, Planning Commission recommended <br />approval of the variance, finding that the encroachment has no <br />visual encroachment effect within the neighborhood, the hardship <br />being the discrepancy between the right-of-way and the actual <br />traveled roadway. Planning Commission further recommended that <br />no Hold Harmless Agreement be required for the septic system <br />within the right-of-way, indicating the City should not force <br />applicant to give up her right to make a claim against the City <br />if at some time in the future the City disrupts the septic <br />system, since the City staff approved the system location. <br />Staff Rec ndation: <br />A resolution ref '.e�`Lng toe Planning Commission <br />recommendation is attached for Council review. <br />PROPOSED MOTION: Moved by _, seconded by _, to approve a <br />resolution granting a 22' front setback variance to Carolynne <br />Hibbs at 2765 Fox Street for the construction of a 2-story deck <br />addition.
