Zoning File #1090 <br />November 11, 1986 <br />Page 6 of 6 <br />d) Given these criteria, the normal code requirements for <br />locating, sizing and use of accessory structures are applicable, <br />except that no accessory structure shall be located less than 50, <br />from the right-of-way line of County Road 6. The above standards <br />shall serve as guidelines in the granting of future conditional <br />use permit approvals per Municipal Code Section 10.03, <br />Subdivision 10. <br />10. On Lot 2, for purposes of establishing the allowable locations <br />for accessory structures, the following criteria should apply: <br />(for discussion) <br />11. This subdivision shall not be approved by the City until such <br />time that the City Council finds that: a) a Homeowner's Association <br />exists, the membership structure of which provides for inclusion of <br />all owners of property gaining access via Hollander Road; and b) such <br />Homeowner's Association has adopted covenants and by-laws which <br />provide for the private maintenance of Outlot A, Hollander Road. <br />Summary: Staff recommends approval subject to: <br />- Removal of rental house, two barns, detached garage, and County Road <br />6 access, with Developer's Agreement to guarantee such removals; <br />- Septic testing prior to Council review; <br />- Show standard drainage easements and wetlands easement on final <br />plat; <br />- Grant variances for lot width for Lot It principal structure setback <br />for Lot 2; <br />- Optional conditions for discussion: <br />a) Establishment of accessory structure setbacks for Lot 1 and 2 <br />as guidelines for future conditional use permit application; <br />b) Require establishment of Homeowner's Association that <br />acknowledges responsibility for the road. <br />
