Min nr"oW :dt1Lt•Muniripel OfficM <br />On the North u,.,re of Lake Minnetonka <br />Hand relivered 1/15/87 <br />Richard Little <br />Hennepin County Government Center <br />Examiner of Titles <br />A705 <br />Minneapolis, MN 55487-0067 <br />Dear Mr. Little: <br />In the process of reviewing a subdivision for lot line <br />rearrangements of three lots within Holly Acres Second Addition, <br />the City Attorney's office has advised that the original document <br />entitled "Declaration of Private Road Easement and Declaration <br />for Maintenance of Same" (copy enclosed herewith) was not <br />executed by the original owner and developer, Hildur Hollander. <br />It is the City Attorney's opinion that the document, although <br />filed by the Registrar of Titles office, would not be valid/legal <br />if contested by a future owner. <br />In our phone conversation of January 14, 1987, you had opined <br />that since the document was accepted for filing and recorded <br />against each Certificate of Title that if a lot had been sold or <br />exchanged in ownership at least once and never contested at that <br />time the document would be valid per previous court rulings.
