• STAFF DISCUSSION PER ITEM 9 REGARDING RENTAL USE: <br />Staff notes that applicant is proposing nc rental use of <br />this structure, but wishes to keep it as a guest house. Staff <br />notes that: <br />a) The former use as a rental house was a non -conforming <br />use and, if it has not been rented out for a period of 12 <br />months, may never be rented out again. <br />b) The City cannot approve a subdivision which creates a <br />situation that is in conflict with the Zoning Code <br />provisions, and cannot grant a use variance to allow two <br />primar; residential units on a single lot. Two primary <br />residential units would be out of character with the <br />neighborhood. (Given a and b, staff contends that rental <br />use is not an option.) <br />REGARDING GUEST HOUSE USE: <br />A conditional use permit for use of this building as a <br />quest house has never been formally applied for. The guest house <br />use would appear to be a new use subject to the standards of <br />Section 10.20, Subdivision 3 (G), which it cannot meet. Staff <br />contends that the variances to 10.20, Subdivision 3 (G) that <br />would be required in order to grant the conditional use permit <br />are expensive and inconsistent with approvals of other rural <br />residential guest house conditional use permits granted by the <br />City. <br />REGARDING STORAGE F-RUCTURE USE: <br />The structure does meet the standards for use as an <br />accessory storage structure, i.e. meets 10' side/structure set- <br />backs, meets front and rear setbacks, is behind "front line of <br />house" based on Hollander Road being front of lot, and is less <br />than 1,000 s.f. in area. Plumbing would have to be removed to <br />ensure no use as a guest house or dwelling unit. <br />
