Zoning Fire #1090 <br />Notice of Planning Commission Action <br />January 27, 1987 <br />Page 3 of 4 <br />Issue F. Performance standards for existing structures. <br />9. Lot 1 does not meet the code requirements for a second <br />dwelling unit (quest house) in that, per Section 10.20, <br />Subd. 3 (G), the guest house does not meet all regular lot <br />requirements. Planning Commission recommends that this <br />structure be removed within 6 months of final plat approval <br />(subject to security in the form of a Developer's Agreement <br />and/or Letter of Credit). <br />10. Existing house on Lot 2 requires a variance of 0.71 <br />feet to the required 50'front yard setback from Hollander <br />Road. Planning Commission recommends approval of this <br />variance. <br />11. Existing barns on Lot 2 meet the 10' required setbacks <br />for accessory storage structures, but do not meet the <br />required setback from property lines for animal housing. <br />The 2 barns each exceed the 1,000 square feet maximum area <br />for accessory storage structures. Planning Commission finds <br />per City Attorney opinion that the barns are pre-existing <br />accessory storage structures over which the City has limited <br />authority solely due to a subdivision process. Planning <br />Commission declines to recommend their removal, basec on <br />City Attorney's opinion. (The City may wish to proceed with <br />a hazardous building action separately from the subdivision <br />- this may or may not affect the subdivision process.) <br />Issue G. Performance standards for future accessory structures. <br />12. For Lot 1, Planning Commission recommends that for <br />purposes of placement of ace -sory structures, the Hollander <br />Road lot line is front, c, ity Road 6 is rear. All <br />accessory structures shall be ated to the rear of the <br />extended front lines of the prim, residence, shall meet <br />the standard 10' side setback req. -gent, and shall be <br />subject to a 50' rear (County Road 6) o back. <br />13. For Lot 20 Planning Commission reL mmands that for <br />purposes of placement of accessory structur. a 50' setback <br />shall be required from all lot lines abutti,�g County Road 6 <br />or Hollander Road, and the standard 10' setback shall be <br />required from the lot line abutting Lot 1. Further, <br />accessory structures shall be no closer to County Road 6 <br />than the extended front line of the existr.ig (or future) <br />primary residence on Lot 2, and no closer to Hollander Road <br />than the 50' setback line for no closer than the future <br />setback from Hollander Road oTLany new house constructed on <br />the property). <br />See discussion (attached) following this notice. <br />
