Gaffron, Asst Planning 5 Zoning Administrator <br />Date: February 5, 1987 <br />Subject: 11097 Van Eeckhout Building Corporation/Gary Roderick Const./ <br />Mr. 5 Mrs. Roger Plank - 2020, 2080 Salem Court - <br />Easement Vacation - Resolution <br />List of Exhibits <br />Exhibit A - Memo 5 Exhibits of 1/16/87 <br />Exhibit B - Planning Commission Minutes of 1/20/87 <br />Exhibit C - Planning Commission Action Notice of 1/21/87 <br />Exhibit D - Proposed Resolution <br />Discussion: <br />First, please review the memo of 1/16/87 and the attached survey. <br />Then, note that the triangular Easement, {1, is recommended by staff <br />to be granted between the two property owners, not to the City. <br />Also note that, although Planning Commission recommended that Easement <br />#3 be scrapped and the actual existing electric vtility lines be relocated <br />onto 2080 Salem Court, the City Attorney has indicated that this require- <br />ment serves no public purpose and is not within the City's limited <br />authority to roquire. <br />Therefore, staff recommends only that the applicants provide <br />documentation that an easement granted by 2020 Salem Court in favor of 2080 <br />Salem Court has been executed. <br />Staff Recoe ndation: <br />Staff recommends approval of the easement vacation subject to re- <br />dedication of the appropriate drainage and utility easement to the City <br />over the new lot boundary, and that applicants provide documentation of the <br />private easements over 2020 Salem Court in favor of 2080 Salem Court, per <br />the attached resolution. <br />
