MINUTES OF THE REGULAR ORONO COUNCIL MEETING HELD DECEMBER 8, 1986 <br />11087 ANDERSON CONTINUED <br />Mr. Anderson advised that the FCC' responds to <br />interference complaints immediately. fit- :lso noted that <br />the type of equipment and frequency lie uses precluues <br />interference problems. <br />C.-Ity Attorney Blatz noted that a review of the FCC <br />memorandum of opinion and order dated September 19, <br />1985, does not say that local governments can not <br />regulate placement but must be the least restrictive in <br />order to accomplish the municipal purposes of health, <br />safety and welfare. <br />It was moved by Mayor Butler, seconded by Councilmember <br />Gr.abek, to adopt Resolution #2101 conceptually approving <br />the height and setback variances and conditional use <br />permit pending the following: <br />a) letters of acknowledgement from all the neighbors <br />notified of the initial public hearing <br />b) providing the neighbors with information <br />regarding reception problems <br />c) applicant providing a hold harmless agreement <br />Motion, Ayes 5, Nays 0. <br />#1088 DALE J. McCURDY <br />4041 NORTH SHORE DRIVE <br />VARIANCE <br />RESOLUTION #2102 <br />Applicant was not present for this matter. <br />Councilmember Frahm commented that there seemed to be an <br />excess amount of driveway that was needed and asked why <br />3.6% driveway hardcover could not be removed avoiding <br />the 3.6% hardcover variance. <br />Assistant Zoning Administrator Gaffron explained that. <br />applicant has noted his concerns for adequate room to <br />turn around. <br />Finding that the steep slopes on the property present an <br />extreme hardship in locating the proposed garage <br />elsewhere, it was moved by Mayor Butler, seconded by <br />Councilmember Callahan, to adopt Resolution #2102 <br />granting the varianct as proposed. Motion, Ayes 5, Nays <br />0. <br />#1.093 P 6 A INVESTMENT <br />1380 SIXTH AVENUE NORTH <br />SUBDIVISION <br />PRELIMINARY APPROVAL <br />Present for this matter was John Adams, and the surveyor <br />Gary Gabriel. <br />10 <br />
