At the suggestion of City Attorney <br />Jeffrey Bland of the Hinshaw & Culbertson firm, I am sending you this letter to request <br />formally a 6-month extension of City Council Resolutions 5246 and 4 794. <br />The original approval of this lot line rearrangement (Resolution 4794) was <br />extended by Resolution 5246 through April 22, 2005 to allow my clients to resolve <br />various issues the title work disclosed. I have been working cooperatively with Mr. <br />Bland, my clients, and Guaranty Title Insurance Company to resolve these issues. We <br />were in the process of executing final documents in January of this year when one of the <br />titleholders became a party to marriage dissolution proceedings. We could not proceed <br />with execution of the documents until either those proceedings were completed or the <br />parties thereto resolved any competing claims to the subject property. My understanding <br />is that such a resolution will be forthcoming soon, but not in time to complete execution <br />of the lot line rearrangement documents by the April 22 deadline. <br />In making this request for an extension my clients understand that (i) the City is <br />not obligated to grant this or any subsequent extension and (ii) if the City's requirements <br />are not completed by the new deadline, then the City has no obligation to consent further <br />to the matter.
