CITY of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 5 9 1 2 <br />A RESOLUTION GRANTING VARIANCES <br />TO MUNICIPAL ZONING CODE <br />SECTION 78-1288 <br />AND A CONDITIONAL USE PERMIT <br />PER MUNICIPAL ZONING CODE <br />SECTION 78-1286 AND 78-1250 <br />FILE NO. 09-3425 <br />WHEREAS, Cinda Collins, a single person (hereinafter "the applicant") <br />represents the owners of the property located at 650 Big Island within the City of Orono <br />(hereinafter the "City") and legally described as follows: <br />Lots 6, 7, 8, 25 and 26, PLEASANT VIEW LAKE MINNETONKA, Hennepin <br />County, Minnesota (hereinafter the "property"); and <br />WHEREAS, the applicant has made application to the City of Orono for <br />an after-the-fact variance to Orono Municipal Zoning Code Section 78-1288 to allow <br />12.5% hardcover within the 0-75' setback zone where only 2.6% is permitted for the lake <br />access stair in order to allow an existing replacement retaining wall, lakeshore <br />patio/walkway and lake access stair; and <br />WHEREAS, the applicant has made application to the City of Orono for a <br />conditional use permit pursuant to Orono Municipal Zoning Code Section 78-1250 to <br />allow grading within the 0-75' setback zone. <br />NOW, THEREFORE BE IT RESOLVED by the City Council of <br />Orono, Minnesota: <br />FINDINGS <br />1. This application was reviewed as Zoning File 09-3425. <br />2. The property is located in the RS, Seasonal Recreational District, which <br />requires a minimum lot area of 5.0 acres. The applicant's property is a <br />legal lot ofrecord and has 1.0 acres in total area. <br />Page 1 of 4
