Box 66 <br />Crystal Bay, MN 55323 <br />Phone (952) 249-4600 Fax (952) 249-4616 <br />NOTICE <br />The Planning Commission will hold public hearings in the Orono Council Chambers at 2780 Kelley <br />Parkway on Monday, September 21, 2009, beginning at 6:30 p.m. on the matter of reviewing the <br />following land use applications: <br />09-3411 David Fox , on behalf of Bill Fox Trustee, 1095 Ferndale Road West , LR-1A zoning district, <br />requests a conditional use permit for filling within the 100 year floodplain, and a number of <br />variances in order to construct a new residence on the property . The following variances <br />are requested: an average lakeshore setback variance to locate the house ahead of the <br />average lakeshore setback; a hardcover variance to allow 24% hardcover within the 0-75' <br />zone where O is allowed and 27.5% currently exists; and a lake setback variance in order to <br />construct the new residence as close as 32' from the OHWL where a 75 ' setback is normally <br />required. Additionally, a CUP to fill a portion of the floodplain where the house will be <br />constructed is also requested. <br />09-3422 Richard & Leesa Anderson, 3205 Crystal Bay Road , LR-1C zoning district , request <br />hardcover variances to construct a covered porch and 2-story addition to the existing home <br />on the property . The proposal includes a variance within the 0-75' zone to allow 21 .5% <br />hardcover where 22 .6% currently exists and O is normally allowed ; and a variance within the <br />75 '-250 ' zone to allow 43 .5% hardcover where 25% is normally allowed and 44.4% currently <br />exists . <br />09-3423 Harvest Moon Natural Foods Co-Op, 2380 Wayzata Boulevard West, 8-6 PUD zoning <br />district, requests a PUD amendment to amend PUD No. 1 in order to add retail food sales as <br />a permitted use and commercial site plan review in order for Harvest Moon Natural Foods <br />Co-Op to operate at the above address . <br />09-3424 Michael and Donna Ebertz, 1220 Tonkawa Road, LR-1 B zoning district, request a setback <br />variance to locate entrance monuments and a entry gate approximately 35 feet from the <br />paved traveled roadway of Tonkawa Road where a 40 foot setback is normally required. <br />09 -3425 Hugh P. Morris on behalf of James Johnson , 650 Big Island , RS zoning district , requests an <br />after-the-fact conditional use permit and after-the-fact hardcover variances for lake-side <br />retaining walls and a patio within 75 ' of the OHWL. <br />09-3426 Roger and Nancy McCabe, 1265 Shoreline Drive, LR-1A zoning district, requests average <br />lakeshore , side yard setback and 0-75 ' and 75'-250' zone hardcover variances in order to <br />construct a porch addition over an existing patio . They are requesting 10 .95% hardcover <br />within the 0-75 ' zone where 0% is allowed and 11 .5% currently exists and 41.4% within the <br />75'-250' zone where 24% is normally allowed and 40 .9% currently exists , and a side yard <br />setback of 15 .1 feet for the porch addition where 30 feet is required and a 14.8 foot setback <br />exists.
