Mabusth, Zoning Administrator <br />Date: December 2, 1986 <br />Subject: #1032 Brian Fulmer, 3505 Wayzata Boulevard - <br />Variance To Moratorium (Ordinance No. 26, Second Series) - <br />Resolution <br />At your August 11, <br />1986 meeting, all <br />action was <br />tabled on Brian <br />Fulmer's comprehensive <br />application that <br />would seek <br />a connection to <br />municipal sewer within <br />an area restricted by a Limited <br />Development <br />Ordinance (effective <br />until 12/31/86). <br />The multiple application <br />involves a variance to <br />the moratorium in <br />addition to <br />an amendment of <br />the Comprehensive Plan. <br />The M.W.C.C. has <br />asked that <br />an amendment of <br />the Comprehensive Plan <br />be approved before <br />they would <br />consider a sewer <br />connection for the Fulmer property. <br />The boundaries of the areas subject to change per the most recent <br />Council finding for the Highway 12 study corridor have been defined. <br />The approved extensions of municipal services will not extend west of <br />the intersection of Old Crystal Bay Road and Hl-.ghway 12. The need to <br />withhold action on this application is no longer necessary as the <br />major issues have been resolved. <br />The applicant's plight will seemingly not be corrected based on <br />the extent and level of improvements and services selected by the <br />Council at yo— November 20th Planning meeting - Fulmer's problem <br />remains uniqu <br />Staff ha:: ed the required resolution approving the variance <br />to the morator... r. the findings cited by both staff and Planning <br />Commission. <br />
