NO. 6� � O � A RESOLUTION DECLARING NORTH ARM LANE OPEN AS A PUBLIC ROAD WHEREAS, the City of Orono is a municipal corporation organized and existing under the laws of the State of Minnesota; and WHEREAS, the City of Orono as the local road authority has maintained that roadway known as North Arm Lane as a public road for a period of time in excess of 30 years; and WHEREAS,per Minnesota Statutes SS 160.05 Subd. 1,that portion of North Arm Lane that has not been formally dedicated to the public but which has been used and kept in repair � and worked for at least 6 years by the City of Orono, is deemed as a public highway; and WHEREAS,North Arm Lane is located partially on lands dedicated to the public for road purposes in the record plats of North Arm Estates Fourth Addition,Markoe Addition,and vorth•Arm Overlook; partially on lands never formally dedicated as public roadway; and partially on a 33'wide tax parcel to which the City has acquired fee title, such tax parcel being described as PINS #06-117-23 24 0003 and legally described as: That part of the South 854.5 feet of the Southeast Quarter of the Northwest Quarter of Section 6, Township 117 North, Range 23 West of the St" Principal Meridian, Hennepin County,Minnesota,lying east of the West 280 feet thereof and lying west of the most westerly lines of the plats of Markoe Addition,North Arm Estates Fourth Addition and North Arm Estates, which line is extended in a northerly direction � parallel to the West line of said Southeast Quarter to the North line of the South 854.5 feet thereof. (hereinafter refened to as"the tax parcel"); and WHEREAS,the City of Orono wishes to formalize the public road status of North Arm Lane. • � Page 1 of 2
