CITY of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. OJ 9~ <br />4. Permanent docks are allowed by Conditional Use Permit in the floodway and flood <br />fringe of Lake Minnetonka per the provisions of Orono Municipal Code Section 7 8- <br />l 116( a)(8). <br />5. The Orono Planning Commission reviewed this application on March 21, 2005 and <br />recommended approval for a conditional use permit for construction of a pennanent <br />dock by a vote of 6-0, based on the following findings: <br />a) The property is on Echo Bay of Lower Lake, Lake Minnetonka and the <br />proposed dock will be located within a cove area where wave and ice action <br />will be minimal, hence the stability of the dock will be at minimal risk <br />b) The proposed permanent dock is located in Lake Minnetonka and is under the <br />jurisdiction of the Lake Minnetonka Conservation District (LMCD) and is <br />subject to the LMCD pennitting process. <br />c) The proposed permanent dock will be located to meet LMCD setback, <br />location and length standards and is not anticipated to result in conflicts with <br />adjoining docks nor pose any navigation hazards. <br />6. The City Council finds that the conditions existing on this property are peculiar to it <br />and do not apply generally to other property in this zoning district, and that granting <br />of the conditional use permit would be in keeping with the spirit and intent of the <br />Zoning Code and Comprehensive Plan of the City. <br />7. The City Cotmcil has considered this application including the findings and <br />recommendations by the Planning Commission, reports by City staff, c01mnents by <br />the applicant and the effect of the proposed conditional use permit on the health, <br />safety and welfare of the community. <br />Page 2 of 5
